1. Purpose
MeraFix is a platform built for legitimate, US-based appliance repair businesses. This AUP exists to: (a) protect our customers, their End Users, and the public from harmful or unlawful use of the Service; (b) ensure we remain in compliance with the laws and regulations that govern automated communications, consumer privacy, and data processing; and (c) keep the Service reliable and secure for everyone who uses it.
Using the Service means you have read and agree to follow this AUP. If you see a use case that is not explicitly addressed here and you are uncertain whether it is permitted, contact us at [email protected] before proceeding.
2. Prohibited Uses
You must not — and you must not permit your sub-users or End Users to — use the Service for any of the following purposes:
2.1 Illegal activities and fraud
- Any activity that violates applicable federal, state, or local law or regulation;
- Fraud, misrepresentation, identity theft, or impersonation of any person or entity;
- Unauthorized access to, use of, or disclosure of another person's private data or credentials;
- Facilitating payment fraud, money laundering, or any financial crime;
- Operating a business that requires a license you do not hold (e.g., practicing a regulated trade without the required certification).
2.2 Harassment, threats, and harmful content
- Harassing, threatening, intimidating, or stalking any individual;
- Publishing or transmitting defamatory, libelous, or unlawfully discriminatory content;
- Inciting violence or hatred against any group or individual;
- Using the Service to contact any person in a manner specifically designed to frighten or distress them.
2.3 TCPA and CAN-SPAM violations
- Automated calls and texts without consent: Using the AI Phone feature or any SMS function to call or text any person who has not provided the required prior express written consent under the Telephone Consumer Protection Act (TCPA), or whose consent has been revoked;
- STOP opt-out non-compliance: Sending any SMS message to a recipient who has previously sent a STOP, UNSUBSCRIBE, CANCEL, END, or QUIT reply, or who has otherwise revoked consent through any channel you operate;
- Repeated calls designed to harass: Using the AI Phone or any dialing function to call the same number repeatedly for the purpose of harassment, even if each individual call would otherwise be lawful;
- Commercial email without consent:Sending unsolicited commercial email ("spam") that does not comply with the CAN-SPAM Act — including emails lacking a valid physical mailing address, emails with deceptive subject lines, or emails that fail to honor unsubscribe requests within 10 business days;
- Do-Not-Call violations: Calling numbers on the National Do Not Call Registry or any applicable state do-not-call list without a valid legal exception (such as an established business relationship or written consent).
2.4 AI call recording violations
- Disabling, overriding, suppressing, or otherwise bypassing the AI's built-in disclosure that: (a) the caller is speaking with an AI, and (b) the call is being recorded. This disclosure is legally required in all two-party-consent states and is a condition of using the AI Phone feature;
- Modifying AI prompts or configurations in a way that causes the AI to deny being an AI when directly and sincerely asked by a caller, or to actively mislead callers about the nature of the entity they are speaking with;
- Using recordings of calls without complying with any applicable notice or consent requirements under state wiretap, eavesdropping, or surveillance laws.
2.5 Spam, deceptive, and harmful communications
- Sending commercial mass communications — whether by phone, SMS, or email — without the recipients' valid prior consent;
- Sending content that is knowingly false, deceptive, misleading, or designed to trick recipients into taking an action against their interests;
- Sending phishing messages, fraudulent invoices, or communications that impersonate a trusted entity to extract sensitive information.
2.6 Infrastructure abuse and security attacks
- Attempting to probe, scan, or test the vulnerability of any MeraFix system or network, or to breach any security or authentication measures without our written authorization;
- Reverse-engineering, decompiling, or disassembling any part of the Service or attempting to derive its source code;
- Using automated tools (bots, scrapers, crawlers) to extract data from the Service at rates exceeding published API rate limits, or in a manner that degrades service for other customers;
- Circumventing, disabling, or defeating any access control, multi-factor authentication, session management, or rate-limiting mechanism;
- Introducing malware, ransomware, viruses, trojans, worms, logic bombs, or other malicious or damaging code into the Service or through the Service to any third party;
- Conducting denial-of-service or distributed denial-of-service attacks against the Service or any third party using the Service as a launchpad.
2.7 Impersonation
- Impersonating MeraFlow LLC, MeraFix, or any MeraFix employee in any communication, on any platform, or within the Service;
- Creating an account under a false business name or using another business's identity to register or operate an account.
2.8 High-risk and regulated decision-making
- Medical or life-safety advice:Using the Service — including the AI Phone feature — to provide medical diagnoses, treatment recommendations, mental-health counseling, emergency dispatch, or any other advice where an error could endanger a person's health or life. The Service is designed for appliance repair scheduling; it is not certified or appropriate for safety-critical decisions;
- Consumer credit and background checks: Using the Service to make or facilitate consumer credit decisions, employment background checks, tenant screening, insurance eligibility determinations, or other decisions governed by the Fair Credit Reporting Act (FCRA) or similar laws;
- Data brokering: Selling, licensing, or otherwise distributing personal information collected through the Service to third-party data brokers or for any purpose unrelated to operating your appliance repair business.
2.9 Competing use
- Using the Service — including its AI infrastructure, landing-page generation system, or dispatch tooling — to build, operate, or train a product or service that competes with MeraFix;
- White-labeling or reselling access to the Service without a separate written reseller agreement with MeraFlow LLC.
3. Reporting Violations
If you believe someone is using the Service in violation of this AUP — including sending unlawful automated calls or texts, harassing consumers, or otherwise abusing the platform — please report it to us at:
- Abuse reports: [email protected]
- Legal matters: [email protected]
Please include as much detail as possible: the nature of the violation, any relevant phone numbers, email addresses, or account identifiers, and the date and time of the incident. We will investigate promptly and take appropriate action.
4. Enforcement
We take AUP compliance seriously. Upon receiving a report or independently detecting a potential violation, we may:
- Investigate: Review account activity, call logs, message history, and any other relevant records to determine whether a violation has occurred;
- Issue a warning: For first-time or minor violations, contact the account holder to explain the concern and request remediation;
- Suspend access: Temporarily suspend an account or specific features (for example, the AI Phone feature) while an investigation is ongoing or pending corrective action;
- Terminate the account: Permanently terminate access, with or without advance notice depending on the severity of the violation, as described in Section 19 of the Terms of Service;
- Preserve and disclose records: Retain records relating to the suspected violation and disclose them to law enforcement, regulators, or affected parties where required by law or valid legal process; and
- Seek legal remedies: Pursue civil or criminal remedies against individuals or entities responsible for serious violations.
We do not guarantee uniform enforcement in every instance. Our decision to take or refrain from action in any particular case does not waive our right to act in other cases. Enforcement decisions are at our sole discretion, subject to our obligation to act in good faith.
5. Changes to This Policy
We may update this AUP from time to time to reflect changes in law, technology, or platform capabilities. For material changes, we will provide at least 30 days' advance notice by email to the address on your account before the updated AUP takes effect. We may provide shorter notice where a change is required by law or is necessary to address an active security threat. Continued use of the Service after the effective date constitutes your acceptance of the revised AUP.
